Copyright Policy
Servana respects the intellectual property rights of others and expects users to do the same. This Copyright Policy describes how we handle copyright infringement claims in accordance with principles equivalent to the Digital Millennium Copyright Act (DMCA) and Nigerian copyright law.
1. Copyright Protection
Original works including text, images, videos, music, software, and designs are protected by copyright law. Unauthorized reproduction, distribution, or display of copyrighted material on Servana is prohibited.
2. Reporting Copyright Infringement
If you believe your copyrighted work has been used on Servana without authorization, send a written infringement notice to our designated agent:
Email: legal@servana.ng
Subject line: Copyright Infringement Notice
Your notice must include:
- Identification of the copyrighted work: Describe the original work or provide a URL to the authorized version
- Identification of infringing material: Provide the specific URL(s) on Servana where the infringing content appears, or sufficient detail to locate it
- Your contact information: Name, address, phone number, and email
- Good faith statement: A statement that you believe in good faith that use of the material is not authorized by the copyright owner, its agent, or the law
- Accuracy statement: A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner
- Signature: Physical or electronic signature of the copyright owner or authorized representative
3. Our Response to Valid Notices
Upon receiving a valid infringement notice, Servana will:
- Promptly review the claim (typically within 48 hours)
- Remove or disable access to the allegedly infringing content
- Notify the user who posted the content of the removal and the basis for it
- Document the complaint for repeat infringer tracking
4. Counter-Notification
If your content was removed and you believe the removal was mistaken or that you have the right to use the material, you may submit a counter-notification to legal@servana.ng including:
- Identification of the removed content and its location before removal
- A statement under penalty of perjury that you have a good faith belief the content was removed due to mistake or misidentification
- Your name, address, phone number, and email
- Consent to jurisdiction of Nigerian courts
- Your physical or electronic signature
If we receive a valid counter-notification, we may restore the content after 10 business days unless the original complainant files a court action.
5. Repeat Infringer Policy
Servana maintains a policy of terminating accounts of users who are repeat copyright infringers. A user is considered a repeat infringer after receiving two or more valid infringement notices. Termination is at Servana's discretion and may occur sooner for egregious violations.
6. Misrepresentation
Knowingly submitting a false infringement notice or counter-notification may result in liability for damages, including costs and attorney fees, under applicable law.
